Privacy & data protection
Protecting your personal data matters a great deal to us. Below we explain in detail how we handle your data.
Data processing on this website
We (or our web hosting provider) automatically collect and store in our server log files information that your browser sends to us. This is:
– browser type and version
– operating system used
– referrer URL (the page visited before)
– host name of the accessing computer (IP address)
– time of the server request.
We cannot assign this data to specific persons. It is not combined with other data sources, and it is deleted after statistical analysis.
Collection and protection of personal data
In line with the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG), we collect personal data only where the law permits it and where you voluntarily give it to us as part of a reservation request, a member card request or a newsletter sign-up. Without your separate consent, we use the data you give us solely to answer your requests, to fulfill and process the related services and to send invitations by post to events we organize. We do not use customer data for advertising unless you have expressly agreed to further use of your data. When you sign up for the newsletter, your email address is used, with your consent, for our own advertising until you unsubscribe. You can unsubscribe at any time.
Sharing of personal data
We pass your address data to the shipping company commissioned with delivery where this is necessary to deliver the member card or other items. Your address data is passed on solely for shipping and is not stored by the shipping companies.
Contacting us
When you contact us (for example by contact form or email), we store your details to process your request and in case follow-up questions arise.
Newsletter and current offers
Our newsletter tells you about us and our offers. As a registered newsletter recipient you will also receive other current offers and information about promotions of P1 Gaststätten GmbH. To receive the newsletter and other offers, we need a valid email address and information that lets us verify that you own the address given, or that its owner agrees to receive the newsletter and other offers. No other data is collected. This data is used only to send the newsletter and current offers and is not passed on to third parties. When you sign up, we store your IP address and the date of sign-up. This serves solely as proof in case a third party misuses an email address and signs up for the newsletter without the owner's knowledge. You can withdraw your consent to the storage of the data and the email address, and to their use for sending the newsletter and current offers, at any time. You can do so through a link in the newsletter itself or by message (for example by contact form or email).
External links
For your information, our pages contain links to third-party websites. Where this is not obvious, we point out that a link is external. We have no influence on the content or design of these third-party pages. The guarantees of this privacy policy therefore do not apply there.
Right to information
You have the right to request information at any time, free of charge, about the scope and purpose of data processing and about further recipients of the data. You also have the right to have your data corrected, blocked and deleted once a request has been completed.
Technical security
To protect your confidential data from third-party access, we use an SSL certificate from Verisign. With this SSL (Secure Socket Layer) transmission, your personal data such as your name and address is transmitted in encrypted form.
Use of cookies
We use cookies to make visiting our website more user-friendly. Cookies are small text files stored on your computer. Most of the cookies we use are deleted from your hard drive as soon as you close your browser (session cookies). Persistent cookies remain on your computer and let us recognize it on your next visit, even if you visit other websites in the meantime. Please note, however, that you may then not be able to use all functions of this website in full. Cookies do no harm to your computer and contain no viruses.
Use of Google Analytics
This website uses Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses cookies, text files stored on your computer that allow an analysis of how you use the website. The information the cookie generates about your use of this website is usually transferred to a Google server in the USA and stored there. General terms and conditions of P1 Gaststätten GmbH
Prices: All prices are in euros plus statutory VAT. If more than 120 days pass between conclusion of the contract and the start of the event, P1 Gaststätten GmbH reserves the right to change prices, provided this is reasonable for the contracting party. Such a price change can be based only on circumstances that would reduce the profit of P1 Gaststätten GmbH if prices were not adjusted (in particular a rise in the consumer price index, in production and personnel costs, or in purchase prices).
Acceptance of orders: All offers are non-binding until the order has been accepted.
Number of participants: The client undertakes to inform P1 Gaststätten GmbH in writing of the exact number of participants and the final choice of food and drink no later than 5 working days before the event.
These details are deemed guaranteed contract content and will be taken into account in the final invoice. Any further orders of food, drink, additional material, staff, etc. will be charged separately at the list prices of P1 Gaststätten GmbH.
Complaints: Obvious defects can be considered only if the complaint is made immediately on receipt of the goods or directly on collection. Goods ordered incorrectly by the client cannot be exchanged in the case of food and luxury foods.
Hidden defects in delivered goods (perishable food) must be reported to us immediately, and no later than 2 days after discovery. P1 Gaststätten GmbH accepts no liability for improper storage by the client.
Payment: Our services are due for payment as follows: 50% of the total cost on placing the order, but no later than 7 days before the event, and the remaining balance without deduction within 14 days of receipt of the final invoice. Default interest is charged in the event of late payment.
Retention of title: For all orders, P1 Gaststätten GmbH retains title to delivered goods until the purchase price has been paid in full.
Loss, breakage or damage of rented items: The client is responsible for the care of rented items from handover to return. In the event of damage, breakage or loss through the fault of the client, or fault attributable to the client, in particular of its employees or guests, the cost of replacement or repair will be invoiced. We also accept no liability for items brought onto the premises.
Cancellation: If an event is canceled, we charge the client the following costs: up to 14 days before the event, 30% of the total order value; up to 7 days before the event, 50% of the total order value; from the 6th day before the start of the event, 100% of the total order value. If rooms in the Haus der Kunst, that is the Terrassensaal, terraces, theater or other side rooms, have also been rented for the event, the following additional costs apply: up to 56 days before the event, 50% of the rent; up to 28 days before the event, 100% of the rent. The client may prove that no damage, or less damage, has occurred.
Place of jurisdiction and place of performance: The contractual relationship is governed by German law. If the client is a registered merchant and the contract is part of the operation of its commercial business, the place of jurisdiction and place of performance for both parties is Munich.
Written form: Deviating agreements or side agreements must be in writing to be effective. By signing, our general terms and conditions are accepted as part of the contract.
